L agent diplomatique et le consul général de Belgique au Japon auront le droit de voyager librement et sans empêchement dans toutes les parties de l empire. L emplacement que les Belges occuperont et sur lequel ils pourront construire leurs habitations sera déterminé par le consul belge de concert avec les autorités japonaises compétentes de chaque lien; il en sera de même pour les règlements de port; et, si le consul et les autorités locales ne parviennent pas à s étendre à ce sujet, la question sera soumise à l agent diplomatique belge et au gouvernement japonais. Autour des lieux où résideront les Belges, il ne sera élevé ni plac, par les autorités japonaise, ni mur, ni barrière, ni clôture, ni tout autre obstacle qui pourrait entraver la libre sortie ou la libre entrée de ces lieux. Les Belges pourront circuler librement dans les enceintes formées par les limites désignées ci-après De Kanagawa jusqu à la rivière Logo (qui se jette dans la baie de Yédo entre Kawasaki et Sinagawa) et dans toute autre direction, jusqu à une distance de dix ris. D Hakodate jusqu à une distance de dix ris dans toutes les directions. Ces distances seront mesurées par terre, à partir du Gojosio, ou maison de ville, de chacun des ports susnommés, le ri équivalant à 3,910 mètres. A Nagasaki, les Belges pourront se rendre partout dans le domaine impérial du voisinage. Art. 4. Les Belges au Japon auront le droit d exercer librement leur religion. A cet effet, ils pourront élever, sur le terrain destiné à leur établissement, des édifices pour l exercice ou à l usage de leur culte. Art. 5. Tous les différends qui pourraient s élever entre les Belges résidant au Japon, au sujet de leurs propriétés ou de leurs personnes, seront soumis à la juridiction des autorités belges constituées dans le pays. Tout Belge qui aurait à se plaindre d un Japonais devra se rendre au consulat de Belgique et y exposera sa réclamation. Le consul examinera ce qu elle sura de fondé et cherchera à arranger l affaire à l amiable. De même, si un Japonais avait à se plaindre d un Belge, le consul de Belgique l écoutera avac intérêt et cherchera à arranger l affaire à l amiable. Si des difficultés surviennent qui ne puissent pas être aplanies ainsi par le consul, ce dernier aura recours à l assistance des autorités japonaises compétentes, afin que, de concert avec elles, il puisse examiner sérieusement l affaire et lui donner une solution équitable. Si quelque Japonais venait à ne pas payer ce qu il doit à un Belge, ou s il se cahait frauduleusement, les autorités japonaises compétentes feraient tout ce qui dépendrait d elles pour le traduire en justice et obtenir de lui le payement de sa dette; et si quelque sujet belge se cachait frauduleusement ou manquait à payer ses dettes à un Japonais, les autorités belges feraient de même tout ce qui dépendrait d elles pour amener le délinquant en justice et le forcer à payer ce qu il devrait. Ni les autorités belges, ni les autorités japonaises ne seront responsables du payement de dettes contractées par leurs nationaux respectifs. Art. 6. Tout Japonais qui se rendrait coupable de quelque acte criminel envers un Belges sera arrêté par les autorités japonaises compétentes et puni conformément aux lois du Japon. Les sujets belges qui se rendraient coupables de quelque crime contre des Japonais ou contre des sujets ou citoyens d autres nations, seront traduits devant le consul de Belgique ou un autre fonctionnaire public compétent, ou devant les tribunaux belges, et seront punis conformément aux lois du royaume de Belgique. La justice sera équitablement et impartialement administrée de part et d autre. Art. 7. Toutes les réclamations d amendes ou confisecations encourues par suite d infractions au présent traité ou aux règlements commerciaux qui y sont annexés, seront soumises à la décision des autorités consultaires belges. les amendes ou confiscations qui seront imposées par celles-ci appartiendront au gouvenement japonais. Ils ne payeront que les droits stipulés dans le tarif annexé au présent traité, sans avoir à supporter aucune autre charge. Les Belges pourront librement acheter des Japonais et leur vendre toutes sortes d articles, sans intervention d aucun employé japonais, soit dans ces ventes ou achats, soit dans les payements à effectuer ou à recevoir. Tous les Japonais, sans distinction, pourront acheter aux Belges toutes sortes de marchandises ainsi que les garder, les employer ou les revendre. Art. 9. Le gouvernement japonais n apportera aucun obstacle à ce que les Belges résidant au Japon puissent prendre à leur service des Japonais et les employer à toute occupation que les lois ne prohibent pas. Art. 10. Les règlements commerciaux annexés au présent traité seront considérés comme en faisant partie intégrante, et ils seront en conséquence également obligatoires pour les deux hautes parties contractantes. L agent diplomatique de Belgique au Japon, de concert avec les fonctionnaires qui pourraient entre désigneés à cet effet par le gouvernement japonais, auront le pouvoir d établir dans tous les ports ouverts au commerce les gèglements qui seraient nécessaires pour mettre à exécution les stipulations des règlements commerciaux ci-annexés. Art. 11. Les autorités japonaises, dans chaque port, adopteront telles mesures qui leur paraîtront le plus convenables pour prévenir la fraude et la contrebande. Art. 12. Tout bâtiment belge arrivant devant l un des ports ouverts du Japon sera libre de prendre un pilote pour entrer dans le port, et de même, lorsqu il aura acquitté toutes les charges et tous les droits qui lui auraient été légalement imposés et qu il sera prêt à partir, il sera libre de prendre un pilote pour sortir du port. Art. 13. Les Belges qui auraient importé des marchandises dans l un des ports ouverts du Japon, et payé les droits établis, pourront obtenir des chefs de la douane japonaise un certificat constant que ce payement a eu lieu, et il leur sera permis alors de réexporter ces marchandises et des les débarquer dans l un des autres ports ouverts du Japon, sans avoir à payer de droit additionnel d aucune espèce. Art. 14. Toutes les marchandises importées par des Belges dans l un des ports ouverts du Japon, et qui auront payé les droits fixés par ce traité, pourront être transportées par les Japonais dans toutes les parties de l empire, sans avoir à payer aucune taxe ni aucun droit de transit ou de toute autre nature. Art. 15. Toute monnaie étrangère aura cours au Japon et passera pour la valeur de son poids comparé à celui de la monnaie japonaise analogue. Les Belges et les Japonais pourront librement faire usage des monnaies étrangères ou japonaises dans tous les payements qu ils auraient à se faire réciproquement. Les monnaies de toutes espèce, à l exception de la monnaie japonaise de cuivre, pourront être exportées du Japon, aussi bien que l or et l argent étrangers non monnayés. Art. 16. Si les chefs de la douane japonaise n étaient pas satisfaits de l évaluation donnée par des négociants à quelques-unes de leurs marchandises, ces fonctionnaires pourraient en estimer le prix et offrir de les acheter au taux ainsi fixé. Si le propriétaire refusait d accepter l offre qui lui aurait été faite, il aurait à payer aux fonctionnaires de la douane les droits proportionnels à cette estimation. Si, au contraire, l offre était acceptées, la valeur offerte serait immédiatement payée au négociant sans escompte ni rabais. Art. 17. Si un bâtiment belge venait à naufrager ou à être jeté sur les côtes de l empire du Japon, ou s il était forcé de charcher un refuge dans quelque port du territoire impérial, les autorités japonaises compétentes, ayant connaissance du fait, donneraient immédiatement à ce bâtiment toute l assistance possible. Les personnes du bord seraient traitées avec bienveillance, et on leur fournirait, si cela était nécessaire, les moyens de se rendre au consulat belge le plus voisin. Art. 18. Toutes sortes de fournitures à l usage des bâtiments de guerre belges pourront êt débarquées à Kanagawa, à Hakodate et à Nagasaki, et placées en magasin à terre sous la garde d employés belges, sans avoir à payer de droits; mais si quelques-unes de ces fournitures étaient vendues à des Japonais ou à des étrangers, l acquéreur payerait aux autorités japonaises la valeur des droits qui y seraient applicables. Art. 19. Il est expressément stipulé que le gouvernement de S.M. le roi des Belges et ses sujets jouiront librement, à dater du jour où le présent traité entre en vigueur, de tous les droits, immunités et priviléges ou avantages qui ont été accordés ou qui seraient accordés à l avenir par S.M. le taïcoun du Japon au gouvernement ou aux sujets de toute autre nation. Art. 20. Il est convenu que les deux hautes parties contrantes pourront, à dater du 1er juillet 1872, proposer la révision du présent traité, pour y introduire les changements ou les améliorations que l expérience aurait démontrés nécessaires. Mais une pareille proposition devra être annoncée au moins une année d avance. Art. 21. Toutes les communications officielles de l agent dipolomatique et des consuls de Belgeique adressées aux autorité japonaises seront écrites en français. Toutefois, pour faciliter la prompte expédition des afaires, ces communications seront accompagnées d une traduction en langue hollandaise ou japonaise, pendant les cinq premières années qui suivront la date où présent traité entrera en vigueur. Art. 22. Le présent traité est fait en quatre expéditions, dont deux sont écrites en japonais et en hollandais et les deux autre en français et en hollandais. Les trois versions ont le même sens et la même portée, mais la version hollandaise sera considérée comme le texte original du traité, de manière que, dans le cas où une interprétation différente serait donnée au texte français et au texte japonais, le texte hollandais ferait foi. Art. 23. Le présent traité sera ratifié par S.M. le roi des Belges et par S.M. le taïcoun du Japon, et les ratifications, dûment singées et scellées, seront échangées à Yédo aussitôt que faire se pourra. Ce traité entrera en vigueur à partir du premier janvier mil huit cent soixante-sept, soit que les ratifications soient échangées avant ou après cette date. But there s a time limit. Stay connected for too long, and the codebreaker disconnects. That way, you avoid triggering alarms. You can usually reconnect again after a few seconds.
